PHYSITAL.ART, (“PHYSITAL,” “we,” “us”) operates an online service that allows artists (“Artists”) to create and sell non-fungible tokens (each an “NFT,” collectively, “NFTs”), each associated with a work of digital art (each a “Digital Work,” collectively, “Digital Works”), and any rights, products, services, privileges, and/or benefits that Artists may choose to offer in connection with such sales (collectively, “Utility”), through our website, accessible at www.physital.art (the “Website”), together with other services, software, tools, features, and functionality made available by PHYSITAL (each, a “Service,” collectively, the “Services”).

These terms and conditions apply to any order of NFT or Product placed on the Site.

When the user places an order on the Site, the user will be asked to confirm acceptance of the Terms and Conditions which include the Terms and Conditions relating to the Product. Some of the provisions contained in these Product Terms may be superseded or supplemented by additional terms and conditions or notices that will be posted on the Site.

In the event of a conflict between these Product Terms and any additional terms or notices, the additional terms shall prevail. By placing an order on the Site, the Buyer certifies that he/she is a non-trading individual of legal age acting for his/her personal needs. He/she certifies that he/she has the capacity to contract, and acknowledges that he/she has previously read and accepted without restriction the General Conditions including the Conditions relating to the Product at the time of placing the order.

ALL TRANSACTIONS INITIATED THROUGH OUR WEBSITE ARE EFFECTED BY THIRDPARTY DIGITAL WALLET EXTENSIONS (each, an “Extension”). BY USING OUR SERVICES, YOU AGREE THAT SUCH TRANSACTIONS ARE GOVERNED BY THE TERMS OF SERVICES AND PRIVACY POLICY FOR THE APPLICABLE EXTENSIONS.
